Overview

This website, bibbito.com, is operated by eircore LLC, which trades as Bibbito. In these terms, "we", "us" and "our" mean Bibbito (eircore LLC). "You" means anyone who visits the site or buys from us.

These terms of service ("terms") apply when you browse our site, create an account or place an order. They work together with our Refund policy and Shipping policy, which are part of these terms. Our Privacy policy explains how we handle your personal information. Please read them before you order.

By using the site or placing an order, you agree to these terms. If you don't agree, please don't use the site.

Our store runs on Shopify, which provides our online store platform.

Your statutory rights

Nothing in these terms excludes, restricts or changes any right you have by law as a consumer that can't be excluded, restricted or changed by a contract. That includes your rights under the consumer laws of the UK and the European Union (such as the right to cancel an online order within 14 days of delivery), the consumer guarantees under the Australian Consumer Law, and the consumer laws of your US state. If anything in these terms conflicts with those rights, those rights apply.

1. Online store terms

  • To place an order, you need to be an adult (the age of majority where you live) and able to enter into a binding contract.
  • You may not use our products or the site for any illegal or unauthorized purpose, or break any law where you live (including copyright law) when you use the site.
  • You may not send or upload worms, viruses or any other harmful code.
  • If you break any of these terms, we may end your access to the site (see section 16).

2. General conditions

  • We may refuse service to anyone for any lawful reason. If we refuse an order you've already paid for, we'll refund you in full.
  • Payments are processed by third-party payment providers. Your card details are encrypted when they're sent, and we don't receive or store your full card number.
  • Other information you send us (not card details) may travel over various networks and may be adjusted to work on different devices.
  • The text, photos, designs, logos and other content on the site belong to us or the people who license them to us. Please don't copy, reproduce, sell or resell any part of the site, our content or our products without our written permission.
  • Headings in these terms are for convenience only and don't change what the terms mean.

3. Accuracy of information on this site

We work hard to keep the site accurate and up to date. Even so, some information may occasionally be incomplete or out of date. Older content, such as past blog posts or announcements, is there for reference and may not reflect how things are today.

We may update the site at any time, but we don't have to update everything, except where the law requires it. If a product detail matters to you, such as size, materials, age range or fit, please check the product page and label, or email us before you order.

4. Changes to the site, products and prices

  • Prices are shown in US dollars (USD) and may change without notice. The price you pay is the price shown at checkout when you place your order, unless there's an error (see section 11).
  • If your card uses a different currency, your bank or card issuer may apply its own exchange rate or fees.
  • Depending on your country, customs may charge import duties or taxes when your order arrives. These are your responsibility unless they were collected at checkout. Our Shipping policy has the details.
  • We may change, pause or stop offering the site, or any product, at any time.
  • If you've already paid for an order that we can't fulfill, we'll promptly refund you in full.

5. Products

Some products may only be available online through our site, and quantities may be limited. Returns, refunds and exchanges follow our Refund policy. Delivery, tracking and import duties are covered in our Shipping policy.

We try to show colors, designs and details as accurately as we can. Screens display colors differently, so what you see on your device may not match the product exactly.

We may limit sales of any product to any person, region or country, and we may change product descriptions or prices at any time. We describe our products as accurately as we can. If an item arrives damaged, defective, wrong or not as described, our Refund policy explains what we'll do, and your statutory rights still apply.

Using the Bibbito Head Cushion

The Bibbito Head Cushion is a soft plush cushion worn like a tiny backpack that rests behind your baby's head during the sitting and learning-to-walk stage. Every baby moves at their own pace. When you buy or use it, you agree to use it as intended:

  • Use it only for awake, supervised, upright play, with you close by.
  • It is not a helmet, not a medical device and not safety equipment. It cannot prevent bumps or injuries, and it doesn't replace your supervision.
  • Take it off for naps and sleep, and before your baby goes into a car seat, stroller, carrier or high chair. Take it off for bath time and any time around water.
  • The straps go over the shoulders, never around the neck.
  • Check the straps, clip and seams before each use. If anything is damaged or worn, stop using it and email us.
  • Follow the label, instructions and warnings that come with the product, including the age range and fit guidance. Our How it fits page walks you through it.

Any other product we sell comes with its own instructions and warnings. Please read and follow them too. If you're not sure whether a product suits your child, email us before you order and we'll help.

6. Accuracy of billing and account information

  • We may refuse or cancel any order, and we may limit or cancel quantities bought per person, per household or per order. This includes orders placed by or under the same customer account, the same payment card, or orders that use the same billing or shipping address.
  • If we change or cancel your order, we'll let you know using the email address you gave us, and we'll refund anything you paid for the cancelled part of the order in full.
  • We may limit or decline orders that, in our judgment, appear to be placed by dealers, resellers or distributors.
  • Please give us current, complete and accurate details for every purchase, and keep your account up to date, including your email address, shipping address and payment details, so we can complete your order and contact you. If an address is wrong or incomplete, our Shipping policy explains what happens.
  • We accept major cards and PayPal. The options available to you are shown at checkout. By placing an order, you authorize us to charge the total shown at checkout. Charges appear on your statement as "BIBBITO".
  • If you create an account, keep your login details private. You're responsible for activity under your account. If you think someone else is using it, please email us right away.

7. Optional tools

We may give you access to third-party tools on the site that we don't monitor, control or provide input into. To the extent the law allows, we provide these tools "as is" and "as available", without any promises or conditions of any kind, and we're not responsible for your use of them.

Using optional tools is at your own discretion. Please make sure you're comfortable with the terms of the third-party providers that offer them. Any new features or tools we add to the site are also covered by these terms.

8. Third-party links

Some content, products and services on the site may come from third parties, and the site may link to third-party websites, such as carrier tracking pages, payment providers or social media. We aren't responsible for checking or evaluating that content, and to the extent the law allows, we're not responsible for third-party websites, their content, products or services, or their practices.

Please review a third party's own policies before you buy from them or share information with them. Complaints, claims or questions about third-party products or services should go to that third party.

9. Comments, feedback and other submissions

We love hearing from parents. If you send us ideas, suggestions, feedback or other comments, by email, through our contact form, on social media or otherwise, we may use them to improve our products and service without owing you payment, except where the law requires it. We don't have to keep feedback confidential or reply to every message, but we'll always handle your personal information as described in our Privacy policy.

We may, but don't have to, monitor, edit or remove content that we reasonably decide is unlawful, offensive, threatening, defamatory, obscene or otherwise objectionable, or that breaks anyone's intellectual property rights or these terms.

When you send us comments, you agree that they won't break anyone's rights, including copyright, trademark, privacy or personality rights, and won't contain unlawful, abusive or obscene material, viruses or other harmful code. Please don't use a false email address, pretend to be someone else, or mislead us or others about where a comment came from. You're responsible for the comments you send and for their accuracy.

10. Personal information

How we collect, use and share personal information when you use our store is explained in our Privacy policy.

11. Errors, inaccuracies and omissions

Now and then, the site may contain typos, inaccuracies or omissions in product descriptions, pricing, promotions, offers, delivery estimates or availability. We may correct them, update information, or cancel orders if information on the site or in any related service is inaccurate, at any time and without prior notice, including after you've placed your order. If this affects your order, we'll email you.

If we cancel an order you've paid for, we'll refund you in full. If a pricing error means an item should cost more than you paid, we won't charge you more without your agreement. We'll email you and you can choose to go ahead at the correct price or cancel for a full refund.

We don't have to update, change or clarify information on the site, except where the law requires it. An update date on a page doesn't mean everything on the site has been updated.

12. Prohibited uses

Along with the other rules in these terms, you may not use the site or its content:

  1. for any unlawful purpose;
  2. to ask others to carry out or take part in any unlawful act;
  3. to break any international, federal, state, provincial or local law or regulation;
  4. to infringe our intellectual property rights or anyone else's;
  5. to harass, abuse, insult, harm, defame, slander, disparage, intimidate or discriminate against anyone based on gender, sexual orientation, religion, ethnicity, race, age, national origin or disability;
  6. to submit false or misleading information;
  7. to upload or send viruses or any other harmful code that may affect the site, any related website, other websites or the internet;
  8. to collect or track other people's personal information;
  9. to spam, phish, pharm, pretext, spider, crawl or scrape;
  10. for any obscene or immoral purpose; or
  11. to interfere with or get around the security features of the site, any related website, other websites or the internet.

We may end your use of the site if you break any of these rules.

13. Disclaimer of warranties and limitation of liability

This section applies only as far as the law allows. It doesn't limit your statutory rights (see "Your statutory rights" above).

The site

We don't promise that the site will always be available, uninterrupted, timely, secure or error-free, or that any information on it will be complete or accurate. We may take the site offline for periods of time, or close it, with or without notice. Apart from the products you buy, the site and its content are provided "as is" and "as available".

Products

Our products are sold as described on their product page and label. If an item arrives damaged, defective or wrong, our Refund policy explains what we'll do.

You also keep every warranty, guarantee and condition the law gives you. That includes implied warranties under your state's law, the consumer guarantees under the Australian Consumer Law, and your UK or EU rights if an item is faulty or not as described. We don't make other promises about our products beyond these.

Limits on our liability

To the extent the law allows, eircore LLC (trading as Bibbito) and its owners, employees, agents, contractors, suppliers and service providers won't be liable for any indirect, incidental, special, punitive or consequential loss or damages, such as lost profits, lost revenue, lost savings or lost data, arising from your use of the site or any product.

Where the law allows a cap, our total liability for any claim relating to a product is limited to the amount you paid for that product.

To the extent the law allows, we're not responsible for loss or damage that results from using a product in a way that goes against its label, instructions or warnings, or from continuing to use a product after it's damaged.

Nothing in these terms excludes or limits our liability for fraud, for death or personal injury caused by our negligence, or for anything else that can't be excluded or limited by law.

14. Indemnification

To the extent the law allows, you agree to cover eircore LLC (trading as Bibbito) and its owners, employees, agents, contractors, suppliers and service providers against any claim or demand made by a third party, including reasonable legal fees, that arises because you broke these terms or the policies they include, or broke any law or someone else's rights.

15. Severability

If any part of these terms is found to be unlawful, void or unenforceable, that part will still apply as far as the law allows, and the unenforceable portion will be treated as removed. This won't affect the validity or enforceability of the rest of the terms.

16. Termination

Obligations and liabilities that arose before these terms end will continue after they end, for all purposes.

These terms apply until you or we end them. You can end them at any time by telling us you no longer want to use our services, or by stopping your use of the site.

If we reasonably believe you've broken these terms, we may end them or deny you access to the site (or any part of it). You'll still be responsible for any amounts owed up to that date. If you have an order that you've paid for and we haven't shipped, we'll either fulfill it or refund you in full.

17. Entire agreement

If we don't exercise or enforce a right under these terms, that doesn't mean we've given up that right.

These terms, together with our Refund policy and Shipping policy, make up the entire agreement between you and us about your use of the site and our services. For new orders, they replace earlier versions of these terms. Orders you've already placed follow the terms in place when you ordered (see section 19).

This doesn't cancel anything we told you about a product before you bought it, such as its description on the product page, that the law treats as part of your purchase.

If any part of these terms is unclear, we'll read it in the way that's most favorable to you where the law requires that.

18. Governing law

These terms, and any separate agreements under which we provide services to you, are governed by the laws of the State of Montana, USA, without regard to its conflict-of-law rules.

If you're a consumer living outside Montana, you still keep the benefit of any mandatory consumer laws of the country or state where you live. Choosing Montana law doesn't take those rights away.

Disputes may be brought in the courts of the State of Montana. If you're a consumer, you may also bring a claim in the courts of the country or state where you live, where your local law allows it.

If something has gone wrong, please email us first at support@bibbito.com. Most issues can be sorted out quickly and simply.

19. Changes to these terms

You can read the most current version of these terms on this page at any time. We may update them by posting changes here, and we'll update the "last updated" date at the top. If you keep using the site after changes are posted, you accept the updated terms.

Changes don't apply to orders you've already placed. Those follow the terms that were in place when you ordered.
